It comes from English regulations, so it does not apply in Scotland, Wales or Northern Ireland, and this checker will tell you plainly if your postcode is outside England rather than guessing. Waited more than 18 weeks? There is a separate duty
Regulations 47 to 49 of the 2012 standing rules put a duty on the responsible body, once you notify it, to take all reasonable steps to offer you an appointment at a different provider that starts treatment earlier. It is triggered by you, not automatically, and it turns on who is carrying out your assessment rather than on the provider's name.
